A personal injury lawsuit is a class of law known as a tort.
A tort (literally, a "wrong") can be any kind of civil wrong or breach of
responsibility. Personal injury is a type of tort that is
broadly defined as damage or harm done to one's body, rights, property, or
reputation.
Torts generally fall into 3 categories:
Intentional torts are any wrong or damage caused
deliberately and knowingly. Examples of intentional torts are trespassing,
libel, slander, defamation, discrimination, invasion of privacy, and causing
emotional distress, as well as acts that also may have criminal liability, such
as assault & battery, and fraud.
Negligence torts are the most common type of tort cases. It
is based on the principle that there is liability when a person does not show
reasonable care in one's actions, and is therefore responsible for damages
caused. Examples of negligent actions that common results in personal injury
torts are medical malpractice,
product liability, and
dog bite injuries.
Strict liability torts are the result of hazardous
activities or use of dangerous products where negligence is not necessary for
the party to be held responsible. This includes
workman's compensation
and construction site accidents.
A successful tort case will establish damages to be paid for financial
losses, as well as pain and suffering, and emotional distress.
