Massachusetts Injury Case Frequently Asked Questions

  • Who pays for damage to my car?

If your car is damaged in an accident, you are entitled to receive money from the person who was responsible for the accident. If your car is slightly damaged you may wish to recover through your own collision insurance.

  • If I make an insurance claim, will my premiums increase?

It depends. Your insurance company can't raise your rates just because you filed a claim, unless it was clearly determined that the accident or incident was your fault.

  • Who pays for my legal fees?

In Massachusetts Injury cases, almost all attorneys charge what is called a contingent fee. This means that a percentage of the gross settlement recovered is paid out as the attorney's fee. If your attorney isn't able to get you a settlement or recover any damage claims, then you don't pay any attorneys fees. In some cases, an attorney may charge the claimant (you) costs in addition to the contingent fees, but you would know that up front.
